Saint Anne Catholic Church located at 32223 Cabello Drive, Union City, CA a tax-exempt organization under Section 501(c)(3) of the United States Internal Revenue Code and Section 23701d of the California Revenue and Tax Code, is conducting a raffle pursuant to California Penal Code Section 320.5, to raise funds for parish hall and classrooms’ improvements. Saint Anne Catholic Church is solely responsible for the Raffle, the administration of the Raffle Official Rules & Regulations set forth herein, and the awarding of the Raffle prize(s).
By purchasing a raffle ticket (also referred to as ‘Entry’), the purchaser (also referred as ‘Entrant’) agrees to be bound by the Raffle rules, limitations, and restrictions as set forth below.
Accordingly, you should read these rules carefully before entering the Raffle.
ELIGIBILITY:
The Raffle is open to all who are residents of the State of California and who are at least 18 years of age at the time of entry. A raffle ticket can be issued only to one (1) Entrant whose name is on the ticket stub or Entry form.
Entry submitted by an individual physically residing outside of California will be automatically disqualified. Entry that is altered and deem defective will be disqualified. The Parish Festival Committee will make the necessary attempts to contact the person written on the entry form.
HOW TO ENTER:
Raffle tickets are sold at $25.00 each. Raffle tickets are available for purchase in person from the following: 1) Saint Anne Parish Office during office hours, 2) from authorized volunteer of the Raffle Sales Team after the conclusion of each weekend mass and 3) from Festival Designated Sellers. Raffle tickets will be also on sale during the festival weekend.
Tickets will be sold up until 6:15 pm on July 28, 2024, subject to availability.
Valid form of payment is check or cash. Tickets will only be issued upon receipt of full payment.
Only entry with confirmed valid funds will be entered in the drawing. The Festival Committee will make every attempt to contact the Entrant with insufficient funds.
Saint Anne Catholic Church assumes no responsibility for lost and late entries.
PRIZES:
Raffle prizes to be awarded are as follows:
1st Prize: $20,000
2nd Prize: $ 8,000
3rd Prize: $ 4,000
Incentive Prizes for Raffle Ticket Sellers:
Highest Seller: $500.00
Seller of the Grand Prize ticket $300.00
ODDS OF WINNING:
The odds of winning a Prize are dependent upon the number of tickets issued by Saint Anne Catholic Church and the number of tickets you purchased. The Parish will issue 4,000 tickets.
The IRS has taken the position that amounts paid for chances in raffles, lotteries, or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
METHOD FOR AWARDING PRIZES:
Saint Anne Catholic Church will conduct a drawing for prize(s) at 6:30pm on July 28, 2024, at the festival grounds located at 32223 Cabello Drive, Union City, CA or at the Parish Office in the event of the cancellation of the festival. The drawing will be conducted by the Pastor of Saint Anne Catholic Church and designated members of the Festival Committee. The winning ticket(s) will be randomly selected from the accepted entries. You need not be present at the drawing to win.
NOTIFICATION OF WINNERS:
Winners will be notified verbally during the drawing. If the Winner is not present, the Parish staff or a designated member of the Festival Committee will notify the winner within 48 hours by phone and/or by sending written notification through the U.S. Mail using the information provided on the Entry form.
If the Winner cannot be located; or fails to respond to attempts at contact or to claim the prize within 30 days from the drawing; or fails to provide all information requested by Saint Anne Catholic Church to be eligible to win, including proof of age, proof of identity, and demonstrable proof that the person claiming the prize is the same person named on the winning Ticket and the winning Ticket stub; or fails to remit any and all taxes due, Winner will be deemed to have forfeited the Prize, and another Ticket will be drawn within 30 days to select a new Winner.
No further tickets will be sold prior to any additional drawing.
EXTENSION OF RAFFLE:
At Saint Anne CatholicChurch’s sole discretion and option, the date for the drawing may be extended by no more than thirty days.
AMENDMENT OF RULES:
If, for any reason, the administration, security, fairness, or integrity of the Raffle has been compromised, Saint Anne Catholic Church reserves the right, exercisable at its sole discretion, to cancel, terminate, modify, or suspend the Raffle. The Official Rules may be amended by Saint Anne Catholic Church at its sole discretion.
GENERAL CONDITIONS
By accepting a prize, the winner grants Saint Anne Catholic Church permission for the use of his/her name, likeness, and biographical information for advertising and promotional purposes without additional compensation, except were prohibited by law.
Saint Anne Catholic Church reserves the right, exercisable upon its sole discretion, to disqualify any individual found to have (1) violated these Official Rules & Regulations; (2) interfered with the entry process or the operation of the Raffle; (3) altered or attempted to alter the random outcome of the Raffle; (4) violated any law or regulation by participating in the Raffle; or (5) fraudulently completed the entry form or provided other false information to Saint Anne Parish.
All taxes, fees, assessments, title and registration fees, insurance, and like charges associated with the receipt or use of the prize, are the sole responsibility of the Winner.
WINNERS WILL BE RESPONSIBLE, AT THE TIME THE PRIZE IS CLAIMED, FOR PAYMENT TO SAINT ANNE PARISH OF THE FULL AMOUNT OF ANY FEDERAL INCOME TAX WITHHOLDING CALCULATED WITH RESPECT TO THE FAIR MARKET VALUE OF THE PRIZE, IF APPLICABLE. THE FAILURE TO PAY THE WITHHOLDING AMOUNT AND PROVIDE A VALID SOCIAL SECURITY NUMBER OR TAXPAYER IDENTIFICATION NUMBER WILL RESULT IN A FORFEITURE OF THE PRIZE WITHOUT FURTHER RECOURSE IN LAW OR EQUITY. ADDITIONALLY, THE VALUE OF THE PRIZE MAY BE REPORTED TO THE INTERNAL REVENUE SERVICE, IN WHICH CASE THE WINNER WILL RECEIVE AN INFORMATION STATEMENT FROM SAINT ANNE CATHOLIC CHURCH FOR PURPOSES OF FEDERAL INCOME TAX REPORTING. FOR ADDITIONAL INFORMATION REGARDING THE TAX CONSEQUENCES OF THE RECEIPT OF THIS PRIZE, PLEASE CONTACT YOUR TAX ADVISOR.
By entering this raffle, the Entrant releases Oakland Diocese, Saint Anne Catholic Church, its clergy, staff and volunteers, from any and all liability for injuries, losses, or damages of any kind caused by participating in the raffle or winning any prize or resulting from acceptance, possession, and use or misuse of any prize, and each winner agrees to indemnify and hold Saint Anne Parish, its clergy, staff, and volunteers harmless from any and all losses, damages, rights, claims and actions of any kind arising out of, in connection with, or as a result of participating in the raffle or the winner’s acceptance or use of any prize. Each Entrant hereby waives the provisions of civil code section 1542, which states the following: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
